Warranty Terms for CineMag Audio Transformers

All CineMag (“Seller”) transformers and inductors (hereinafter “product “ or products”) are warranted to be free from defects in materials or workmanship.  Seller warrants them to meet the published specifications.  No other warranty, expressed or implied, is made by the Seller unless expressly set forth in writing.

PRODUCTS SHALL NOT BE USED AS CRITICAL COMPONENTS IN LIFE SUPPORT DEVICES OR SYSTEMS, OR IN ANY APPLICATION WHERE FAILURE COULD CAUSE INJURY OR DEATH.  

Seller makes no warranty, representation or guarantee regarding the suitability of the product(s) for any particular purpose.

Seller’s warranties are limited to claims for defective materials or imperfect manufacture.  In no event shall Seller be liable to the buyer or any other person for loss of profits, loss of use, or damages of any kind based upon claim for breach of warranty or for faulty workmanship or material.  Customer shall hold Seller harmless from any such claim by others, including attorney’s fees and costs of court.  Seller’s liability is limited to replacement or repair of such part in question as Seller may determine is defective after proper examination by Seller.  In no event shall Seller’s liability exceed the sales price to the Customer for said item manufactured and sold by CineMag when materials are properly returned and found defective or not as ordered.

CineMag shall have no obligation or liability under this warranty for special, indirect or consequential personal or property damage, or injury, or loss of income or profit arising from failure of the product.

There shall be no warranty, unless made in writing by CineMag, for the use of product in equipment that can cause personal injury.

Use or operation of equipment incorporating the product shall be conducted under normal industry conditions, at normal temperatures and pressures, and at normal voltages.

Waivers by the Seller of strict compliance with any one or more of the conditions or terms of sale is not to be considered a waiver of any other clause of these terms of sale.
